2,000 Transgenders Excluded From Final NRC List, Petition Filed

NRC was not inclusive for transgender: Swati Bidhan Baruah

Amid air of disappointment among different sections of people over the exclusion of names from the final list of NRC, Assam’s first transgender judge Swati Bidhan Baruah has filed a petition at the Supreme Court seeking direction over exclusion of over 2,000 transgender people from the citizenship list.

“Most of the transgender people have been abandoned. They do not have documents pertaining to before the 1971. NRC was not inclusive for transgenders,” said Swati while speaking to Time8.

Swati further said that the objection applications did not contain ‘others’ as one of the gender categories. “In fact, they were forced to choose male or female as their gender”, Swati added.

It may be mentioned that the Assam government on August 31st, 2019 published the final NRC. A total of 3,11,21,004 crore people made it to the final list leaving out 19,06,657 persons including those who did not submit claims. On September 14th, 2019 the list with individual statuses of all the included applicants was published online.

The excluded persons can approach the Foreigners’ Tribunals and appeal against their exclusions within 120 days of the publication of the final list. State NRC Coordinator mentioned in a statement that the process of collection of the orders passed by the NRC officers is being carried out to enable early availability of the certified copies of rejection from final NRC list to the public to file appeals.
