Guwahati: The Kamrup district administration by an order under section 144 of Cr PC, has prohibited storage, distribution and selling of zarda/ pan masala/ gutkha/ sikhar etc. in any shop within the district with immediate effect.
The order shall remain in force until further order.
It is in line with Govt. of Assam’s order to implement the Assam Health (Prohibition of Manufacturing, Advertising, Trade Storage, Distribution, Sale and Consumption of Zarda, Gutkha, Panmasala etc. containing Tobacco and or Nicotine Act, 2013.
Inspite of the ban the selling of the above-mentioned items continues in many parts of the district. Reports have also been received that many school-college going students have fallen into the habit of consuming these items endangering their future. Consumption of the items mentioned are antisocial and almost a menace to society.
Therefore, to check such activities the order has been passed and all circle officers, Superintendent of Police of the district shall ensure strict enforcement of the order through all the OCs of Police Stations, ICs of Outpost within Kamrup district.
It is also mentioned in the order that any person aggrieved with the order is at liberty to appear before the DC court within 15 days from issue of the order.
Enforcement of 144 under Cr.PC in Kamrup
In the meanwhile, DC, Kamrup Kailash Karthik N, by an order under section 144 of Cr PC, has prohibited the following activities with immediate effect.
(a) Assembly of five or more persons at any public place with the intention to carry out processions and shouting slogans which may incite public in any place/ highways/ roads and shouting slogans inciting communal violence at any place.
(b) Carrying out arms/ ammunition/ explosives/weapons of any nature in any public place including processions/rally/meeting etc. and in any vehicle including two or three-wheelers.
(c) Gambling in any public place and use of loud speakers throughout the district of Kamrup.
It is assumed that some unspecified persons or group of persons or organizations/ associations may cause a breach of public peace and tranquillity, and disturb normal public life and general administration at any unspecified places within the district of Kamrup. Therefore, the order is enforced with immediate effect and shall be remained in force until further order.
It is also mentioned in the order that any person aggrieved with the order is at liberty to appear before the DC court within 15 days from the issue of the order for filing a written objection, if any, for cancellation/modification of the order.
