    Consumer Court orders Real Estate Developers to Pay Rs 5 lakh to Flat Owners

    Non-fulfillment of all the conditions have allegedly cost difficulty and suffering to the residents of Bali Enclave of VIP road

    GUWAHATI: The District Consumer Court Disputes Redressal Forum, Kamrup has ordered one Neha Builders Real Estate Developers of Beltola Basistha road here to pay compensation of Rs 5.10 lakhs to the residents of Bali Enclave of VIP road here for deficiency in service.

    The forum also ordered to pay the compensation within 45 days to the complainant.

    Earlier, one Prabin Kumar Das, on behalf of 12 other flat owners of Bali Enclave, filed a complaint with Consumers’ Legal Protection Forum (CLPF), a consumer rights organization, alleging that despite assurance Neha Builders Real Estate Developers did not provide required amenities to the residents in spite of full and final payment.

    “The complainant took possession of the flats in the year of 2013.  The facilities as per the commitment made in the advertisement have not been provided by the builders. Even complete electricity connection like earthing, individual energy meter, security measures, parking space for vehicles, sanitary and fire fighting arrangement, proper lift installation, handover of possession certificate was also not done by the builder,” said CLPF advocate Ajoy Hazarika appeared for the complainants.

    The builder had assured in writings to fulfill some of the incomplete works but nothing was allegedly done.

    Later, on the basis of the joint complaint by 12 flat owners of Bali Enclave, in 2017, CLPF filed a case with District Consumer Court Disputes Redressal Forum, Kamrup under sections of the Consumer Protection Act 1986.

    “In its order the District Consumer Disputes Redressal Forum, Kamrup clearly mention that non-fulfillment of all the conditions have cost difficulty and suffering to the residents of Bali Enclave and entitled for compensation,” he added.
