Guwahati: The Gauhati High Court on Friday converted the interim bail granted to Victor Das, a teacher at a private coaching centre to absolute bail.

Das who was arrested last September 9 by Assam Police against a Panbazar PS Case No. 233/2022 was slapped with sections 120B/505/153/153A/384/511 of the Indian Penal Code.

The single judge bench of Justice Robin Phukan in the judgment copy stated that the advocate of the petitioner Victor Das had submitted that a perusal of the FIR reveals that no elements of the offence under the above-mentioned sections are found.

On the other hand, producing the case dairy before the court, the additional public prosecutor submitted that the accused Victor Das has been allegedly indulging in making false allegations through his Twitter handle @KingV_6768 and that the investigating police officer has collected sufficient materials against him and, therefore, it contended to dismiss the petition filed by Victor Das.

The court in its judgment said that “Having carefully going through the materials, so far collected in the case diary, the same leaves this court unimpressed about the existence of the ingredients, which are required to make out offences under which the case has been registered.”

It added, “The accused was arrested on September 9, 2022, and forwarded to the judicial custody on September 10, 2022, and he was been granted interim bail vide order dated September 16, 2022, by this court. There is nothing on record to show that during the period of interim bail has been misused the liberty granted by this court vide order dated September 16, 2022.”

In that view of the matter and the materials so far in the case, the court is of the view that in the interest of the investigation, the custodial detention of the accused Victor Das is unwarranted and thus, the court is inclined to make the interim bail granted vide order September 16, 2022 absolute on the same terms and conditions, the judgment copy stated further.

It may be mentioned that Victor Das (coaching institute tutor) was arrested by Assam police for allegedly spreading rumours regarding the recruitment process for Grade-III and Grade-IV posts under the state government.

In his tweets, Das raised the issue by tagging the chief minister, Assam Police, DGP Assam and GP Singh (Special DGP in Assam). The tweet caused a stir as people on social media started expressing their discontent over the matter and urged the government and the police to take serious note of the issue.

Das was remanded to seven days of police custody by the court.

Earlier, police told the media that Das has been unable to provide any evidence to support his allegations.

Later, five students of the coaching institute reportedly run by Das in the city have also been summoned by the police for questioning.
