    Just Before Execution, SC To Consider Curative Plea By Nirbhaya Convict

    The four convicts were ordered to be hanged on March 3rd, 2020 in the gruesome gang rape and murder of a 23-year-old woman in a moving bus in Delhi, causing massive outrage across the country

    A day before the scheduled execution of four convicts in the Nirbhaya case, the Supreme Court is going to take up on March 2nd, 2020 a curative petition filed by one of them for commutation of the death sentence.

    A bench of Justices N V Ramana, Arun Mishra, Rohinton F Nariman, R Banumathi and Ashok Bhushan would consider the matter inside their chamber on March 2nd, 2020.

    The four convicts were ordered to be hanged on March 3rd, 2020 in the gruesome gang rape and murder of a 23-year-old woman in a moving bus in Delhi, causing massive outrage across the country.

    On February 28th, 2020, Pawan Gupta, one of the four convicts, approached the Supreme Court with a curative petition, seeking reconsideration of final judgement on the ground that he was minor at the time of the incident in 2012.

    Though the Supreme Court had earlier in January rejected his similar plea of juvenility, he has preferred to raise it again in his curative petition.

    A curative petition is decided inside judges chamber, based on documents.

    On February 28th, 2020, two convicts Akshay and Pawan have moved the trial court as well for seeking further postponement of their execution on March 3rd, 2020.

    Akshay claimed he has filed a fresh mercy petition with the President.

    Pawan, for his part, referred to the curative petition filed in the Supreme Court. They said the trial court should re-schedule the date of the hanging, until the decisions were taken in pending matters. The trial court is expected to consider their plea on Monday on getting a response from Tihar jail authorities.

    The date of execution had twice been the changed in the matter due to filing of one petition or another by the convicts.
